PRE-CONTRACTUAL INFORMATION
Before ordering and entering into a contract, the buyer acknowledges having received, in a clear and understandable manner, these general terms and conditions of sale and all information listed in article L.111-1 of the French Consumer Code.
APPLICATION SCOPE AND PURPOSE
These general terms and conditions of sale automatically apply to all sales made by ADC SELECTION SAS to consumers or legal entities purchasing beyond their professional needs. This includes any product sold through the ADC SELECTION SAS website, provided the buyer has completed the mandatory registration fields and has a delivery address within the serviced areas.
By confirming an order on the site, customers fully accept these terms and conditions and the specific conditions of their order. Customers may modify their order or review these terms before finalizing their purchase.
Any order implies unreserved acceptance of these general terms and conditions of sale, which prevail over any other terms and conditions, with the exception of those that have been expressly accepted by ADC SELECTION SAS
Reserves the right to modify the general sales conditions at any time. In this case, the applicable conditions will be those in effect at the date of the buyer’s order.
PRODUCT SPECIFICATIONS
Products on the site are described with their name, quantity, and price.
While photographs aim to visually represent the products, they are not contractually binding.
It is recommended to read the description of the products carefully before validating the order.
VALIDITY OF THE PRODUCT OFFER
Product offers are valid as long as stocks last.
If a product becomes unavailable after ordering, the buyer will be notified within 24 hours on business days.
The buyer may then :
- postpone delivery,
- select an equivalent product,
- or cancel the order for a refund.
PLACING ORDERS
First-time customers will choose a password, which, along with their email, serves as proof of identity and commitment to the order. Customers are responsible for their login credentials.
To order, customers must:
- Fill in the identification form with required contact details
- Select products and quantities online,
- Review and validate the order summary (to validate an order, the customer must accept the present Terms and Conditions by checking the appropriate checkbox that is clearly indicated),
- Make payment,
- Confirm the order and payment.
All provided data by the buyer are binding. Any errors in customer or delivery information that result in lost products will not be reimbursed.
The seller will send confirmation of the order recorded by e-mail.
PAYMENT TERMS
Payment is due upon order placement.
Orders are payable in euros.
Orders are payable via credit card (Carte Bleue, Visa Card or Eurocard Mastercard)through BFCOI's secure system.
The goods and delivery charges must be fully paid before shipping.
ADC SELECTION SAS reserves the right to suspend or cancel any order and/or delivery, regardless of its nature and level of execution, in the event of non-payment of any amount due by the buyer or in the event of a payment incident.
GEOGRAPHIC AREA, DELIVERY TIMES, AND COSTS
Sales are intended for mainland France, with delivery to the specified address,
As an indication, the usual delivery times, following validation of the order, are as follows
Estimated Delivery times are typically :
- Mainland France and other countries listed : 2 to 3 working days after order validation
For all orders confirmed before 12 pm, from Monday to Thursday (excluding bank holidays), the order will be dispatched the same day subject to availability of stocks.
For all orders confirmed on Friday, Saturday and Sunday, the order will be sent on the following Monday within the limit of available product stock.
Shipping costs are calculated at checkout
Delivery is free for orders over €150 incl. tax in mainland France. (après remises, dans le cadre d’opérations promotionnelles)
DELIVERY TERMS
Deliveries in mainland France are fulfilled by Chronofresh.
The customer is responsible for providing the name and address of the recipient (door code, floor, telephone number, etc.) to guarantee all delivery under normal conditions, and to avoid any delay or delivery problems resulting in an additional cost of binding at your expense.
A delivery address in a post office box cannot be taken into account.
The delivery will be made to the address provided by the customer who will then sign the delivery receipt and will be bound to check in the presence of the deliverer for the condition and the number of packages delivered.
In the event of shortages, damage or any other anomaly, the customer shall make comments on the delivery note upon receipt of the package.
If this clause is not observed, no claim procedure against the carrier can be made.
We guarantee the product up to the place of delivery.
In case of absence, the buyer or the consignee of the ordered product receives a notice of passage, which allows him to contact the carrier in order to withdraw his parcel(s). Pick-up must then take place within 24 working hours due to the perishable nature of the product(s).
ADC SELECTION SAS can in no circumstances be held responsible for any deterioration of the products due to the late receipt of a package due to the absence of the customer or the person authorized to receive it.
Furthermore, in the event of an error by the customer in the wording of his details or those of the place of delivery, in particular his surname, first name, address, telephone number, e-mail address, door code, making delivery impossible and resulting in the loss of the products, the customer remains indebted for the payment of the lost products and no refund or compensation will be made.
WITHDRAWAL PERIOD
Any consumer has a period of fourteen (14) days to exercise his right of withdrawal, without having to justify his decision. This period runs from the day of receipt of the goods by the consumer or by a third party designated by him (other than the carrier). If the order concerns several goods delivered separately, the period runs from the receipt of the last good.
The consumer exercises this right of withdrawal by notifying his intention to ADC SELECTION SAS, either by post to 1-7 rue Henri de France, 95780 BEZONS, or by electronic means to the address contact@rova-caviar.com, using the pre-filled withdrawal form available by clicking on this link and which ADC SELECTION SAS undertakes to acknowledge receipt of without delay, or by any other unambiguous statement expressing its desire to withdraw.
The consumer must then return, at his sole expense, the goods to ADC SELECTION SAS, at the latest within fourteen (14) days following the communication of his decision to exercise his right of withdrawal, in their original packaging, unopened, with the seals intact and in perfect condition, accompanied by the invoice issued at the time of purchase. The consumer's liability may only be incurred in the event of depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods.
ADC SELECTION SAS will reimburse payments, including standard delivery costs, without undue delay and, in any event, no later than fourteen (14) days from the day on which the consumer informed the consumer of his decision to withdraw. However, if the returned goods are not received within this period, ADC SELECTION SAS reserves the right to defer reimbursement until receipt of the goods or until the consumer has provided proof of shipment of these goods, the date retained being that of the first of these facts.
Reimbursement is made by the same means of payment as that used by the consumer for the initial transaction, unless the consumer expressly agrees to use another means of payment. In any event, the refund may not result in any additional costs for the consumer.
However, this right of withdrawal cannot be exercised for contracts for the supply of goods likely to deteriorate or expire rapidly. This provision concerns in particular all caviars and all boxes containing caviar offered on the site.
WARRANTY
All products supplied by the seller benefit from the legal guarantee provided by articles 1641 and following of the Civil Code and the legal guarantee of conformity provided by articles L.211-1 to L.212-1 of the Consumer Code.
In the event of non-conformity of a product sold, it may be returned to the seller who will take it back, exchange it or refund it.

LIABILITY
The seller shall not be considered responsible or in default for any delay or non-performance resulting either from the consumer, or from the unforeseeable and insurmountable act of a third party to the contract, or from a case of “force majeure” usually recognized by French case law. War, riot, fire, strikes, accidents and the impossibility of being supplied are considered as cases of “force majeure” discharging the seller from his obligation to deliver.
The seller shall not be held liable for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption or other involuntary problems.
INTELLECTUAL PROPERTY
All elements of the ADC SELECTION SAS website are and remain the exclusive intellectual property of ADC SELECTION SAS.
No one is authorized to reproduce, exploit, rebroadcast or use for any purpose whatsoever, even partially, elements of the site, whether software, visuals or sound elements.
Any simple or hypertext link is strictly prohibited without the written consent of ADC SELECTION SAS.
PERSONAL DATA
ADC SELECTION SAS reserves the right to collect information about buyers, including by using cookies, in order to process orders.
Users have the right to access, rectify and delete their personal data, in accordance with the law of January 6, 1978. ARCHIVING EVIDENCE
ADC SELECTION SAS will archive order forms and invoices on a reliable and durable medium that constitutes a true copy in accordance with the provisions of Article 1348 of the French Civil Code.
The computerized records of ADC SELECTION SAS will be considered by the parties as proof of communications, orders, payments, and transactions between the parties.
DISPUTE RESOLUTION
The present online sales conditions are subject to French law.
The consumer may submit any dispute arising from the conclusion or interpretation of these general terms and conditions of sale to the competent court under the Code of Civil Procedure.
Nevertheless :
- Consumers whose habitual residence is in the territory of a Member State of the European Union may bring their action before the court of their place of residence.
- Consumers whose domicile is in France may also bring their action before the court of the place where they lived at the time of the purchase or of the occurrence of the harmful event.

MEDIATION CLAUSE
In accordance with the provisions of Articles L612-1 et seq. of the French Consumer Code, any Buyer may submit any dispute with ADC SELECTION SAS to a consumer mediator free of charge, failing to resolve the dispute with customer service or failing a response from customer service within two months of the date of the complaint.
The Buyer may thus have recourse free of charge to the consumer mediator to which ADC SELECTION SAS belongs, namely the Centre de Médiation et d’Arbitrage de Paris (CMAP), which will attempt, in all impartiality and independence, to bring the parties together with a view to finding an amicable solution to the dispute between them and which can be contacted electronically at the address consommation@cmap.fr or by post at the following address: Centre de Médiation et d’Arbitrage de Paris – 39 avenue Franklin D.
